Terms and conditions
1. Interpretation and definitions
The words of which the initial letter is capitalized have meanings defined under the following conditions.
The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
- “Tao Trekking” is the Organizer of the trekking and/or the activity
- “Participant” means the individual accessing or using the services of the company, or other legal entity on behalf of which such individual is accessing or using one of the services, as applicable.
- “Website” refers to Tao Trekking, accessible from https://taotrekking.com.
- “Service” means one of the products of Tao Trekking, such as ‘Night in the Woods’ and ‘Switserland TAO Trekking’, specified on the Website.
- “Agreement” is the lawfully finding agreement between Tao Trekking and the Particpant on the offered Service.
a. These are the Terms and Conditions governing the use of this Service and the agreement that operates between the Participant and TAO Trekking. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
b. Participant’s access to and use of the Service is conditioned on Participant’s acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
c. By accessing or using the Service the Participant agrees to be bound by these Terms and Conditions. If Participant disagree with any part of these Terms and Conditions then You may not access the Service.
d. The Participant represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
a. The Service is provided to the Participants "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Tao Trekking, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Tao Trekkings provides no warranty or undertaking, and makes no representation of any kind that the Service will meet the Participants requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
b. Without limiting the foregoing, neither Tao Trekking nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
c. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to the Participants. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
4. Termination by Participant
a. Enough and valid travel insurance is compulsory for all travelers. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. TAO Trekking also recommends it covers trip cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by the company employees or suppliers. TAO Trekking reserves the right to cancel or suspend your participation on a trip or in certain activities that comprise part of a trip, at any time, including after the commencement of your trip, with no right of refund, if you are unable to provide proof of insurance when requested.
b. Cancellation notice is required, must be made in written form, such notice commences from the day your cancellation note is received. Cancellation shall be valid with approval from the company after receiving documentation.
c. If the Participant cancels the Service within two months in advance of the Service/scheduled activity, Participant is obliged to pay 50% of the purchase price. There will be no refund for cancellation notice provided less than three weeks before trip departure
d. If you are prevented from travelling on the tour by genuine circumstances, for example (without restriction) because of death, injury or serious illness of the passenger, close relative or friend, redundancy or jury service, you may postpone your trip or transfer your booking to another person, provided they meet all the requirements relating to that tour. You must provide proof of why you are unable to travel at the time you change your booking. You will be charged a minimal fee of 100 euros. The cost of trip postpone or transfer may be higher depending upon the company’s arrangements with other parties such as hotels, Guest Houses, ground operators or airlines. Postpone or transfer the tour and this applies if you postpone or transfer this tour no less than two weeks prior to trip departure. There will be no options available 14 days before trip departure.
e. If a customer leaves a trip for any reason whatsoever, either voluntarily, involuntarily or if you commit any unlawful act after the trip has commenced. We will make no refunds for any meals, accommodation or services not used.
5. Payment and travel costs
a. All prices stated by TAO Trekking are costs per person in euros.
b. All prices stated by TAO Trekking exclude travel costs of the Participants to the location where the Service takes place.
c. Not included in the prices stated by TAO Trekking are: luggage, travel-, healthcare-, and cancellation insurance and all other costs of personal nature.
d. Payment of the Services of TAO Trekking is processed:
1. Participant books as Service via the Website or via e-mail and receives an invoice.
2. After payment of the invoice, the booking is complete.
6. Limitation of Liability
a. To the maximum extent permitted by applicable law, in no event shall TAO Trekking or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
b. Notwithstanding any damages that the Participant might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and the Participant’s exclusive remedy for all of the foregoing shall be limited to the amount actually paid by the Participant through the Service.
c. TAO Trekking explicitly states that there is no liability for damage that a travel and/or cancellation insurance covers.
d. In case any physical activities are part of the Service of TAO Trekking, Participants need to make their own judgment to see if the Service is suitable to them.
7. Termination by TAO Trekking
a. TAO Trekking reserves the right to cancel any trekking and/or activity you booked unless guaranteed to run.
b. TAO Trekking reserves the right to cancel any trekking and/or activity, including a guaranteed trekking and/or activity, prior to departure due to reasons beyond its control (i.e. due to natural disasters, flight cancellation, consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences. In such a case, TAO Trekking will refund the trip price only. If TAO Trekking cancels a departure which is guaranteed to run, we will refund the trip price, or you are entitled to take an alternative trip of the same value.
c. TAO Trekking is not responsible for any incidental expenses or consequential losses that the Participant may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.
d. The Switserland TAO Trekking has a minimum number of participants of five. Latest three weeks of advance we will inform you when there will be less participants. TAO Trekking can terminate the Agreement if this is the case. If TAO Trekking cancels a departure, we will refund the trip price, or you are entitled to take an alternative trip of the same value. Incidental expenses or consequential losses will not be reimbursed.
8. Nature of activities and responsibilities
a. The Service takes place outside in nature. Participant is aware that weather circumstances can change rapidly and that this is out of control of TAO Trekking
b. Participant is responsible for themselves during the whole trekking and/or activity. This includes both physical and mental ability as well as equipment brought to make sure Participant can join the trekking and/or activity. Participant receives a packing list for the desired equipment well in advance.
c. If the Participants physical or mental ability and/or the equipment does not suffice, TAO Trekking has the right to exclude the Participant from the trekking and/or activity.
d. Participant needs to follow the instructions from TAO Trekking or its suppliers for their own safety.
9. Governing law
The laws of the Netherlands, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
10. Changes to These Terms and Conditions
We reserve the right, at TAO Trekking’s sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use Our Service after those revisions become effective, the Participant agrees to be bound by the revised terms. If the Participant does not agree to the new terms, in whole or in part, please stop using the website and the Service.
